By accessing or using UserHero (the "Service"), operated by AppsYogi ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service, including users who embed our feedback widget on their websites or applications.

UserHero is a user feedback platform that enables businesses to collect, manage, and analyze feedback from their users. Our Service includes:

• Embeddable feedback widget for websites and applications
• Web-based dashboard for managing feedback, projects, and team members
• Third-party integrations including Slack, email notifications, and webhooks
• Secure storage for feedback data, screenshots, and attachments

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access or security breaches
• Accept responsibility for all activities that occur under your account
• Confirm that you are at least 18 years old or have parental consent to use the Service

UserHero offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following terms:

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws
• Not use the Service to harm, threaten, or harass others
• Not use the Service to send unsolicited communications or spam
• Not upload or transmit viruses, malware, or other malicious code
• Not attempt to reverse engineer, decompile, or disassemble any part of the Service
• Not use the Service to develop a competing product or service
• Respect rate limits and not attempt to circumvent usage restrictions

The following activities are strictly prohibited when using our Service:

• Using the Service for any illegal or unauthorized purpose
• Collecting or storing personal data of minors without proper consent
• Engaging in harassment, abuse, or any form of discrimination
• Impersonating another person or entity
• Accessing or attempting to access other users' accounts or data
• Interfering with or disrupting the Service or servers

The Service and its original content, features, and functionality are owned by AppsYogi and are protected by international copyright, trademark, and other intellectual property laws.

When you use UserHero to collect feedback from your users, important data processing relationships are established:

• We act as a data processor on your behalf for feedback data collected through your widgets
• You remain the data controller and are responsible for your end-users' privacy
• Our collection and use of your personal data is governed by our Privacy Policy
• You must ensure your use of the Service complies with applicable data protection laws (GDPR, CCPA, etc.)

Please read these disclaimers carefully as they limit our liability:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free
• We do not guarantee any specific uptime or availability of the Service
• We are not responsible for any third-party services, integrations, or content

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

You agree to defend, indemnify, and hold harmless AppsYogi and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your collection of end-user feedback data.

Either party may terminate the agreement under the following conditions:

• You may terminate your account at any time by deleting your account or contacting us
• We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms
• Upon termination, your right to use the Service will immediately cease
• Provisions that by their nature should survive termination will survive (e.g., ownership, disclaimers, indemnification)

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved as follows:

• We will first attempt to resolve disputes informally by contacting each other
• If informal resolution fails, disputes will be resolved through binding arbitration
• You agree to resolve disputes on an individual basis and waive any right to participate in class actions
• Either party may bring claims in small claims court if eligible

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

These additional provisions apply to our agreement:

• These Terms constitute the entire agreement between you and UserHero regarding the Service
• If any provision is found to be unenforceable, the remaining provisions will remain in effect
• Our failure to exercise any right shall not constitute a waiver of that right
• You may not assign or transfer these Terms without our prior written consent
